Carmen practises in employment, work health and safety, the defence of unfair dismissal and general protection claims, management of ill and injured workers and assisting employers with challenging the acceptance of workers' compensation claims.
Carmen advises clients across a range of industries and has strong relationships within private education and state health sectors in Queensland, and routinely assists those clients with reviewing and appealing decisions of the workers' compensation insurer/workers' compensation regulator.
She enjoys forming strong working relationships with clients, to build mutual trust and confidence. As such, clients find her accessible and easy to engage, with a pragmatic and commercially focused mindset.
Carmen routinely advises clients regarding the management of workers in complex circumstances which requires legal knowledge of various legal areas including workers' compensation, employment and workplace health and safety law.
Carmen was recognised in Doyle's Guide as an Employment & WHS Law Rising Star - Queensland, 2023.
McCabes acted for the successful appellant occupier in a recent matter in the NSW Court of Appeal which considered a claim for pure mental harm allegedly sustained by a cleaner present at the aftermath of a fatal car accident.
A recent decision by the NSW Court of Appeal upheld the principle that the plaintiff bears the onus of establishing the cause of his accident. In circumstances where the plaintiff is unable to establish this cause on the basis of the evidence available, the defendant cannot be presumed liable for the incident simply by the mere fact that it occurred.
