The Fair Work Commission (FWC) has handed down the 2021 Annual Wage Review decision, granting a 2.5% increase to the national minimum wage and modern award minimum wages.
The weekly national minimum wage (NMW) will increase by $18.80 to $772.60 per week and the hourly minimum wage will increase by $0.49 to $20.33 per hour.
The ACTU had sought a 3.5% increase with no deferral of operative date, whilst employer groups had sought an increase equivalent to the current rate of inflation (1.1%), to take effect no earlier than 12 months after the last increase. Employer groups had submitted that the Expert Panel should take into consideration the 0.5% superannuation guarantee increase operative from 1 July 2021.
The Expert Panel stated that an increase of the magnitude proposed by the ACTU in the present economic circumstances would pose a real risk of disemployment and adversely affect the employment opportunities of low-skilled and young workers. The Panel acknowledged however that awarding an increase which was less than increases in prices and living costs would amount to a real wage cut.
The Expert Panel noted that contrary to last year’s decision, handed down in a time of great uncertainty during the height of the pandemic, the current performance of the economy is exceeding expectations, with economic recovery well underway. Such factors weighed in favour of a higher increase than was awarded in last year’s Review.
Last year the Expert Panel staggered the operative date of the 1.75% increase into three groups, delaying the increase until February 2021 for employees in sectors it expected to be hardest hit by the coronavirus, such as the retail, airline, hair and beauty, hospitality, and fitness industries.
This year, the Expert Panel considered data showing the differential impact of the pandemic on particular industry sectors, and determined that a more nuanced appropriate was required. It noted for example that whilst the “accommodation and food services” industry was “lagging recovery”, fast food businesses had been less adversely affected, and as such would not be granted a delayed operative start date this year, despite only passing on last year’s increase on 1 February 2021.
As such, the Expert Panel determined that the 2.5% increase will apply to the vast majority of modern awards from 1 July 2021, with the exception of:
(a) the General Retail Industry Award 2020 which will come into effect on 1 September 2021, and
(b) a number of modern awards in the aviation and tourism sectors, the Fitness Industry Award, Restaurant Industry Award and certain retail trade sector (e.g. hair and beauty, dry cleaning) which will come into operation on 1 November 2021.
